1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Mobover, the company operating VoClone ("we," "us," or "our"), regarding your use of the VoClone application and services (collectively, the "Service").

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy.

2. Eligibility

To use VoClone, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Comply with all applicable local, state, national, and international laws

3. Service Description

VoClone is an AI-powered voice cloning platform that allows users to:

• Upload and manage audio and video files
• Create AI-generated voice models from audio samples
• Generate synthetic speech using cloned voices
• Store and organize voice projects and libraries
• Export and share generated audio content

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

4. User Accounts

4.2 Account Security

You are responsible for:

• Maintaining the security of your device and account access
• All activities that occur under your account
• Logging out of your account after each session on shared devices
• Immediately notifying us of any security concerns

Note: Since accounts are anonymous, if you lose access to your device or uninstall the app, you may lose access to your data. Please use the app's backup or export features to save important content.

5. Acceptable Use Policy

You agree NOT to:

• Clone voices without consent: Create voice clones of any person without their explicit written permission
• Impersonation: Use cloned voices to impersonate or deceive others
• Fraud or scams: Generate content for fraudulent activities, phishing, or scams
• Illegal content: Create content that violates laws or regulations
• Harassment: Generate content to harass, threaten, or intimidate others
• Misinformation: Create deepfakes or misleading audio content
• Intellectual property violation: Infringe on others' copyrights, trademarks, or rights
• Hate speech: Generate content promoting violence, discrimination, or hatred
• Adult content: Create sexually explicit or inappropriate content
• Political misuse: Create misleading political content or false endorsements
• System abuse: Reverse engineer, hack, or attempt to compromise our systems
• Spam: Use our Service to generate spam or unsolicited communications

5.2 Ethical Use Requirements

When using VoClone, you must:

• Only clone voices you have explicit permission to use
• Clearly disclose when content is AI-generated in public contexts
• Use the Service in compliance with all applicable laws
• Respect the privacy and rights of others
• Use the Service for legitimate, lawful purposes only

6. Content and Intellectual Property

6.1 Your Content

You retain all ownership rights to the content you upload ("Your Content"), including:

• Original audio and video files you upload
• Voice recordings you create
• Text inputs and scripts

By uploading content to VoClone, you grant us a limited license to:

• Store and process your content to provide the Service
• Use your content to generate voice clones and synthetic speech
• Make temporary copies for backup and security purposes

We do NOT claim ownership of your content and will NOT use it for any purpose other than providing the Service to you.

6.2 Generated Content

AI-generated voice outputs created using our Service:

• Are owned by you, subject to these Terms
• Must be used in compliance with these Terms and applicable laws
• Should be clearly labeled as AI-generated when shared publicly

6.3 Our Intellectual Property

VoClone and all related technology, including:

• Software, algorithms, and AI models
• User interface, design, and branding
• Documentation and instructional materials

Are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

7. Data Security and Privacy

8. Service Limitations and Availability

8.1 Service Availability

We strive to provide reliable service, but:

• The Service is provided "as is" and "as available"
• We do not guarantee uninterrupted or error-free service
• Scheduled maintenance may temporarily affect availability
• We may suspend service for security or legal reasons

8.2 Usage Limits

We may impose reasonable usage limits, including:

• File size limits for uploads (audio: 100MB, video: 500MB)
• Recording duration limits (maximum: 5 minutes per recording)
• Storage capacity limits per account
• API rate limits and processing quotas

9. Fees and Payment

VoClone may offer both free and paid services. If you use paid services:

• You agree to pay all applicable fees as displayed in the app
• Fees are non-refundable unless otherwise stated
• We may change pricing with advance notice
• You authorize us to charge your payment method
• You are responsible for all taxes associated with your purchase

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in the app
• Contacting our support team

Upon termination, your data will be deleted within 30 days.

10.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms of Use
• You engage in prohibited activities
• Required by law or legal authorities
• Your account has been inactive for an extended period
• We discontinue the Service

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE"
• We make no warranties, express or implied, regarding the Service
• We do not guarantee the accuracy, reliability, or quality of AI-generated content
• We are not responsible for how you use generated content
• We do not warrant that the Service will meet your requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for misuse of generated content by users
• We are not liable for any third-party content or services

13. Indemnification

You agree to indemnify and hold harmless VoClone, its affiliates, and employees from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of any third-party rights
• Your generated content and how you use it

14. Dispute Resolution

In the event of any dispute:

• You agree to first contact us to seek informal resolution
• If informal resolution fails, disputes shall be resolved through binding arbitration
• You waive the right to participate in class-action lawsuits

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the application
• Displaying prominent in-app notices
• Updating the "Last Updated" date at the top of this document

Your continued use after changes constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mobover regarding the Service.
